Terms of service

1. Who we are

These Terms of Service ("Terms") are an agreement between you and Pixelite SL, a company registered in Andorra (L-710633-B), which operates ozimmi ("ozimmi", "we", "us"). They govern your use of the ozimmi website and the services offered on it (the "Service"). By creating an account, buying a Case File or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What the service is

ozimmi provides tools to organise your migration information and prepare a cited dossier, and a directory of registered professionals. Its automated output has not been reviewed by a registered migration agent or Australian legal practitioner and may be incomplete, out of date or wrong; check it with a registered professional before acting. 3. Your responsibilities

You are responsible for the accuracy of the information you enter. ozimmi's output is generated by automated systems, including AI, which can make mistakes, and it is unreviewed, so do not treat it as a substitute for a registered professional's own advice: have one review anything before it is lodged, and note that ozimmi does not lodge or represent you.

4. What you can buy: the Case File

Preparing your case is free. The one thing ozimmi sells to applicants is the Case File, a digital product bought once. Download your consultation pack as a PDF, and share it with a registered professional of your choice through a link they can open without an account. The pack is your factual record, the published requirements for the pathways and stages you chose, and what remains unresolved for your consultation. One purchase covers every case on your account. It is generated by software from the information you have entered; no person prepares or reviews it for you.

If our check places you outside Australia when you buy, your Case File also includes a separately labeled report, described at checkout, which you can forward to a registered professional listed in our directory. Forwarding needs a professional to be listed in the directory when you forward, and there may be none listed. Before you pay, the checkout shows which of these your Case File includes, with a sample. The check uses where you say you are, the country your connection comes from and whether your case answers say the applicant is in Australia.

What a Case File includes is decided when you pay and again when the payment completes. If it included the report when you paid, and our check no longer places you outside Australia when the payment completes, it is granted as the consultation pack without the report, and we record why. After that, the report is checked again each time it is delivered, and it is not shown while our check places you in Australia. In either case you can keep the consultation pack, or ask for a full refund within 30 days of the payment, which ends the Case File. This is in addition to the refunds in our Refund Policy at /legal/refund-policy and to any right the law gives you.

A Case File costs US$35, or €35 for buyers in the European Union, paid once. It is not a subscription and nothing renews. Prices are listed at /pricing. It is delivered digitally: it is available on your account as soon as the payment is confirmed, and you use it from your case on the website. A price change never applies to a Case File you have already bought.

5. Who sells it

Depending on your country, your Case File is sold either by our reseller and Merchant of Record, Paddle (Paddle.com Market Limited and its affiliates), or directly by Pixelite SL, with payment processed by Braintree, a PayPal service. Your receipt shows which applies. Where Paddle is the seller, Paddle handles billing, payment, invoicing and the calculation and remittance of applicable taxes, and Paddle's buyer terms at https://www.paddle.com/legal/checkout-buyer-terms also apply.

6. Taxes

Where Paddle is the seller, Paddle determines and collects any VAT, GST or sales tax based on your location. Where Pixelite SL is the seller, the price shown at checkout is the amount you are charged: no VAT, GST or sales tax is added to it or itemised on your receipt.

7. Refunds

Refunds are governed by our Refund Policy at /legal/refund-policy, which forms part of these Terms. A refund is issued by whichever company sold you the Case File.

8. No outcome warranty

We make no warranty as to any migration outcome, invitation or timeframe. Content states the law as at the dates shown with it, and may become out of date as the law changes.

9. Consumer guarantees

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where liability can be limited, our liability is limited to resupplying the service or the fees you paid for it.

10. The marketplace

Professionals listed in the directory are independent third parties. They provide their own registration details, which you should confirm against the public register; we do not employ or supervise them and are not responsible for the advice they give. Any engagement is between you and the professional.

11. Acceptable use

Do not misuse the service, attempt to enter false information to obtain a particular result, or use the service to advise or represent other people on their migration matters unless you are lawfully permitted to do so.

12. Governing law and disputes

These Terms are governed by the laws of the Principality of Andorra, without regard to its conflict-of-laws rules. The courts of Andorra have jurisdiction over any dispute, except where mandatory consumer-protection laws of your country of residence give you the right to bring proceedings in your local courts.
